Disclaimer concerning written statements

In exchange for Company providing services to Client, Client acknowledges and agrees as follows:

Any and all written statements in any Company e-mail, letter, review, report, certification, verification, evaluation, test result, forensic summary, forensic review, or design are expressions of opinion by the expert who authored the statement. Any written statement is an opinion by the expert based on the expert’s skills, training, knowledge, education, and experience.

Any written statement that refers or relates to whether a product or construction material should or should not be used in any particular construction project is an opinion and recommendation of the expert based on the expert’s skills, knowledge, training, education, and experience as applied to the particular needs, design, and specifications, and scope of work of each individual construction project, review, certification, or study.

A written opinion that a product or construction material is not recommended for Client’s project does not mean that the product or construction material does not meet applicable state law, local ordinances, building codes, or energy standards, and in no event does such a recommendation apply to any other construction project.

Client acknowledges and agrees that other experts may reasonably disagree about the suitability of a particular product or construction material to be used in any construction project.
